Welcome to SocialPostingOS. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using SocialPostingOS ("Service," "we," "us," or "our"), you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Service.

SocialPostingOS is a product of Real Estate OS (DBA). References to "we," "us," or "our" in these Terms refer to Real Estate OS and its products.

2. Description of Service

SocialPostingOS is a social media content creation tool designed for real estate professionals. Our Service allows you to:

• Create branded social media posts for property listings
• Generate "buyer need" posts to find off-market properties
• Schedule and manage your social media posting calendar
• Store and organize your listing and buyer information

3. Account Registration

To use certain features of our Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscription and Payment

4.1 Free Plan

Our free plan includes limited features, including one listing and one buyer profile.

4.2 Pro Plan

Our Pro plan is available for $19 per month and includes unlimited listings, buyers, premium features, and a complimentary 1-on-1 Zoom onboarding session. Payment is processed through Stripe.

4.3 Billing

• Subscriptions are billed monthly in advance
• You authorize us to charge your payment method on a recurring basis
• Prices may change with 30 days notice

4.4 Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• We do not provide refunds for partial months

5. User Content

5.1 Your Content

You retain ownership of all content you upload, including photos, listing information, and branding materials ("User Content"). By uploading User Content, you grant us a limited license to store and process it to provide the Service.

5.2 Content Responsibility

You are solely responsible for:

• Ensuring you have rights to all content you upload
• The accuracy of listing information and pricing
• Compliance with real estate advertising regulations in your jurisdiction
• Obtaining necessary permissions for photos and images

5.3 Prohibited Content

You may not upload content that:

• Infringes on intellectual property rights
• Contains false or misleading information
• Violates fair housing laws or regulations
• Is defamatory, obscene, or otherwise objectionable

6. Social Media Platform Compliance

When sharing content created with our Service to third-party platforms (Facebook, Instagram, LinkedIn, TikTok, X/Twitter, Google Business Profile), you agree to comply with each platform's terms of service and community guidelines. We are not responsible for any actions taken by these platforms against your accounts.

7. Intellectual Property

The Service, including its design, features, and code, is owned by SocialPostingOS and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALPOSTINGOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless SocialPostingOS from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination using our export feature.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maricopa County, Arizona.
